ESTIMATED PRICE
The estimated price is the value that the auction house has given to a specific object and as such appears in the catalogue. The estimated price is not the minimum price (Reserve).*
CATALOGUE DESCRIPTION
Every item submitted for auction is described in the catalogue, and the given information is correct to the best of our knowledge; however, these details do not represent a legal guarantee and are provided for informational purposes only. The objects on offer are used items and are auctioned caveat emptor (without a warranty), that is, regarding defect of quality by the auction house and under exemption of any kind of guarantee. All items are sold in the condition that was current when the bid was accepted. The term “current condition of the item” is not used consistently throughout the catalogue. During the previews, which are conducted before each auction on our premises, you have the opportunity to view and check each item. We kindly ask you to review the condition of each item to your own satisfaction.*
BIDDING
You can obtain a bidding number before our auctions and during our previews.
Written and telephone bids (available only for items in access of €3,000 in value) must be placed 24 hours prior to the auction with a legally binding signature on an order form. This also holds true for bids sent per fax. The price given on the form is considered as the maximum bid. The accepted bid, however, may be lower.
In the case of telephone bidding, we cannot guarantee that a permanent line is available and assured throughout the auction. If you are bidding per telephone, we consider the reserve price to be your minimum bid.*
BID ACCEPTANCE
The bid is accepted if, after three calls, no higher bid is offered. The auctioneer can conditionally accept the bid, in the event that the seller’s reserve has not been met. In this case, you are bound to your bid for three weeks. Your bid becomes invalid if you do not receive an unconditional acceptance of your offer within this period of time or if someone else offers the reserve price. (See Post-Auction Sales)*
POST-AUCTION SALES
For up to three weeks after the auction, offers may be placed on any unsold items during a post-auction sale. The sale price in this case is the reserve price agreed upon by the seller plus a surcharge.
SURCHARGE
The items sold are taxed (depending on the seller) according to differential or regular taxation.
In the case of differential taxation, a 25% surcharge is added to the accepted bid. Additionally, a Resale Royalty (droite de suite) may be charged. The total price includes VAT, which is assessed without a separate invoice.
Regular taxation may be used for art traders who are tax exempt for art and antiquities. In this case, the final price is the accepted bid plus a 19% surcharge plus standard VAT and Resale Royalty where applicable.
You can reclaim VAT if the purchased items are transferred to countries outside the EU and as soon as you have provided the auction house with the export certificate.*
ARTIST’S RESALE RIGHTS
In order to comply with the law governing Artist’s Resale Rights (§ 26 UrhG)), the auction house pays a compensation fee (based on the selling price) to the Ausgleichsvereinigung KUNST for all original works of visual art created after 1900. The purchaser has to bear a share of this fee in the amount of 1 % of the purchase price. All items to which this fee is applicable are marked with an “X” in the catalogue.*
PAYMENTS
Payments may be made in cash (Euros), with an EC card or by bank transfer. We do not accept credit cards. In the case of non-cash payments, all costs, taxes and surcharges (including bank fees) must be met by the buyer. Please check all invoices during or immediately after the auction. You will incur interest charges in the case of a delay in payment.*
PICK UP
We kindly request that purchased items be picked up immediately at the auction house once the invoice has been settled. Shipment of items can be arranged upon request only and at your own risk and cost. If necessary we would be happy to find you a suitable transport company or a specialist art-removals firm.*
